1. Introduction

1.1 Purpose: This DMCA Policy outlines Ringtree LLC's ("Ringtree," "Ringtree LLC", "we," "us," or "our") procedures for responding to notifications of alleged copyright infringement in accordance with the Digital Millennium Copyright Act ("DMCA") for our RingTree service.

1.2 Scope: This policy applies to all content transmitted, stored, or displayed through RingTree services, including our website, mobile applications, and telephony services (collectively, the "Services").

1.3 Compliance: Ringtree respects the intellectual property rights of others and expects our users to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us.

2. Reporting Copyright Infringement

2.1 Notification Requirements: If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Services, please notify our copyright agent as set forth in the DMCA. For your complaint to be valid under the DMCA, you must provide the following information in writing:

a) An electronic or physical signature of a person authorized to act on behalf of the copyright owner;
b) Identification of the copyrighted work that you claim has been infringed;
c) Identification of the material that is claimed to be infringing and where it is located on the Service;
d) Information reasonably sufficient to permit Ringtree to contact you, such as your address, telephone number, and email address;
e) A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or law; and
f) A statement, made under penalty of perjury, that the above information is accurate, and that you are the copyright owner or are authorized to act on behalf of the owner.

3. Counter-Notification Procedures

3.1 Counter-Notice: If you believe your content that was removed (or to which access was disabled) is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your content, you may send a counter-notice containing the following information to the DMCA Agent:

a) Your physical or electronic signature;
b) Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled;
c) A statement that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content; and
d) Your name, address, telephone number, and email address, a statement that you consent to the jurisdiction of the federal court in [Your State], and a statement that you will accept service of process from the person who provided notification of the alleged infringement.

3.2 Reinstatement: If a counter-notice is received by the DMCA Agent, Ringtree may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed content or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member or user, the removed content may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at Ringtree's sole discretion.

4. Repeat Infringer Policy

4.1 Account Termination: Ringtree will terminate user accounts that have been subject to three (3) or more valid DMCA takedown notices. We reserve the right to terminate user accounts that are subject to multiple invalid takedown notices.

4.2 Account Reinstatement: Ringtree may, at its sole discretion, reinstate terminated user accounts if it determines that the user has taken appropriate steps to address the behavior that led to account termination.

5. Modifications to Policy

5.1 Updates: Ringtree reserves the right to modify this DMCA Policy at any time without individual notice to users. Changes will be posted on our website, and the "Last Updated" date at the top of this policy will be revised.

5.2 Continued Use: Your continued use of RingTree Services after any changes to this DMCA Policy constitutes your acceptance of the modified policy.
